These Terms of Service ("Terms") govern your use of DimCon Pro, a macOS desktop application developed and operated by N.C.A Vertelman ("we", "us", or "our"). By downloading, installing, or using DimCon Pro, you agree to be bound by these Terms. If you do not agree, please do not use the app.
Description of Service
DimCon Pro is a macOS application designed for professional survey data processing and 3D point cloud analysis. The app provides tools for geometric fitting (lines, circles, planes), coordinate transformations, station merging, interactive 3D visualization, and data import/export. DimCon Pro is intended for use by surveyors, engineers, and professionals working with 3D coordinate data.
Subscriptions and Billing
DimCon Pro is available through a subscription model with monthly and yearly plans, offered exclusively through the Apple App Store.
Billing: All payments are processed by Apple. We do not handle or have access to your payment information. Subscription pricing is displayed in the app and on the App Store listing.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends.
Cancellation: You can manage or cancel your subscription at any time through your Apple ID account settings on your Mac or at apps.apple.com. Cancellation takes effect at the end of the current billing period. You will retain access to the app's features until that date.
Refunds: Refund requests are handled by Apple in accordance with their refund policies. To request a refund, visit reportaproblem.apple.com.
Free Trial: If a free trial is offered, it will be clearly stated at the time of subscription. Unused portions of a free trial are forfeited once a paid subscription begins.
License Grant
Subject to your compliance with these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use DimCon Pro on devices that you own or control, solely for your personal or internal business purposes.
Acceptable Use
You agree not to:
- Copy, modify, distribute, sell, or lease any part of DimCon Pro
- Reverse-engineer, decompile, or disassemble the app or attempt to extract its source code
- Use the app for any unlawful purpose or in violation of any applicable laws or regulations
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the app
- Attempt to bypass or circumvent subscription verification or licensing mechanisms
Accuracy of Results and Professional Disclaimer
DimCon Pro performs mathematical computations, geometric fitting, and coordinate transformations based on algorithms that use numerical approximation methods. While we strive for accuracy, results are inherently subject to the limitations of floating-point arithmetic, input data quality, and algorithmic approximations.
Important: Results produced by DimCon Pro are provided for informational and professional reference purposes only. You are solely responsible for independently verifying all computational results before relying on them for any professional, engineering, construction, or safety-critical decisions. DimCon Pro is a tool to assist your workflow, not a substitute for professional judgment and independent validation.
We make no guarantees regarding the accuracy, precision, or suitability of any computed results for any specific purpose.
Intellectual Property
DimCon Pro, including its design, code, algorithms, graphics, user interface, and documentation, is the intellectual property of N.C.A Vertelman and is protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
Limitation of Liability
To the maximum extent permitted by applicable law, N.C.A Vertelman shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or project files
- Inaccurate or unexpected computational results
- Business interruption or loss of profits
- Damages arising from reliance on results produced by the app
Our total liability for any claim arising from or related to DimCon Pro shall not exceed the amount you paid for the app in the twelve (12) months preceding the claim.
Warranty Disclaimer
DimCon Pro is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be error-free, uninterrupted, or free of harmful components, or that results produced by the app will meet your specific requirements or accuracy standards.
Termination
We may suspend or terminate your access to DimCon Pro if you violate these Terms. Upon termination, your license to use the app ceases immediately. Provisions of these Terms that by their nature should survive termination (including Limitation of Liability, Warranty Disclaimer, and Governing Law) shall continue to apply.
You may terminate this agreement at any time by cancelling your subscription and uninstalling the app.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.
If you are a consumer residing in the European Union, you also retain any mandatory protections provided by the consumer protection laws of your country of residence.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be reflected by an updated "Last Updated" date at the top of this page. Your continued use of DimCon Pro after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
